Right to admission is reserved with the management.
Entry to the premises of Kaizen Wellness Center (“Center”) can may be denied (irrespective of valid confirmed booking of any wellness programs or services) in the event of over booking, government regulation, technical faults/breakdown of equipment, law and order situation and or any other force majeure situation (as the case may be). In such an event, customers/members are entitled to a refund of money paid by them towards the booking. Customers/members are not entitled to claim any other expenses/compensation of any nature whatsoever.
The term "customer”/“member" shall include but is not limited to any persons availing of the wellness programs at the Center, either on a paid; promotion; complementary or invited basis by the Center on behalf of themselves or others in their care.
Customers/ members are only permitted to enter the Center on their scheduled date and during the specific class time they have chosen. Entry is not permitted at any other time unless the customer/ member wish to visit our Kaizen cafe. Once inside the Center, customers and members must leave promptly at the end of their scheduled class.
Entry to the Center is limited to individuals with confirmed bookings for wellness programs made through the designated online portal or in person at the Center. However, customer/ member may visit the Kaizen Café during regular business hours.
The permissible age for entry to the Center is 18 years. Any customer/member under the age of 18 years (“minor”) will not be allowed entry into the Center unless accompanied by a guardian. Entry for minor shall be restricted only to the classes curated specifically in this regard.
A valid government photo ID should be carried for verification before entering the Center. A valid passport is a must for all international customer/member coming to the Center, and if required they will have to furnish the same along with valid Indian Visa upon request.
Dress Code for entry into the Center is strictly gym wear/workout attire. Customers/members are required to wear suitable and appropriate non-provocative clothing at all times.
Customers/Members entering the Center with their face covered due to religious, health or any other reasons must abide by the rules and cooperate with the staff, security, and management to uncover their faces if whenever asked to for the purposes of identification at any point of time while in the premises of the Center.
Backpacks, laptop bags, and bags of larger size is prohibited at the workout premises and the same may be deposited by the customers/members, by availing the open locker facilities which are set-up at the designated area at the Center, subject to availability. Further, customers/members are not permitted to carry laptop, camcorder, DSLR etc. on the workout floor/other premises of the Center.
No dangerous or potentially hazardous objects, including but not limited to knives, guns, weapons etc. is permitted in the Center.
Customers/members are not allowed to bring outside food into the Center. No request, if any made for storage of outside food at the Center will be entertained.
Photography and videography are strictly prohibited at the Center.
Smoking and vaping are strictly prohibited at the Center.
Customers/members in an inebriated state will not be allowed entry into the Center.
Management reserves the right to refuse customers/members, if it believes, they are in an inebriated state. Customers/members found in an inebriated state at Center, will be asked to leave the premises, the discretion of which lies solely with the management. Further, the said customers/members will be liable to pay damages to the Center (if any).
Management reserves the right to remove individual customers/members from the Center in case of unruly or disruptive behavior. Customers/members must not use foul, loud, or abusive language, physically or sexually abuse, or harass other members, guests, visitors, or members of staff, or conduct themselves in any manner which shall be considered as an i
nappropriate behavior by the Centre. On occurrence of such an event, it will result in immediate expulsion from the session and termination of membership or as decided by the management of Centre.
Management reserves the right to close the Center, Kaizen Cafe or any area within the Center due to private bookings or for any other reason as the management deems fit.
Debit and Credit credit cards used by the customers/members for carrying out transactions at the Center should have the name of the cardholder and should be supported by an o
riginal government issued identity proof. If any booking amount exceeds INR 50,000/- (Rupees Fifty Thousand Only) in case of cash and INR 2,00,000/- (Rupees Two Lakhs Only) in case of any other mode of payments or more the customers/members will be mandatorily required to submit copy of their Pan Card.
Debit/credit cards belonging to joint account holders and/ or companies or such other legal entities will not be accepted.
International cards are accepted subject to condition that customer/ member provide valid copies of VISA and Passport.
Non usage of the programs/classes/session, availed at the Centre (either through the online portal or physically at the Center) does not affect any payment terms and conditions and the Centre is in no way responsible for non-usage of the Centre. It is not the responsibility of Centre to notify the members of non-usage.
In case of cancellation of membership, the customer/member to submit a prior written notice within 15 days of the intended date of cancellation with the Center.
The customers/members shall take care of their valuables and belongings and in case of any loss, the management will not be responsible.
Any unclaimed valuables and/or belongings for more than 15 (fifteen) days at the Center shall be confiscated and the management shall not be responsible.
The use, transportation, or possession of illegal drugs or narcotics (including marijuana) or of any other contraband, or the participation in any other anti-national or unlawful activity is strictly prohibited.
In case if any customer/member is found in possession of illegal drugs or narcotics (including marijuana) or of any other contraband then the management reserves the right to remove the individual customer/member from the premises or as well as report to the same to the authorities. In the event, the customer/member is required to vacate the premises for contravention of the above rule, they will not be entitled for refund of any fee paid and/or any expenses incurred at the Center.
Customers/members are not permitted to bring children into the Centre, nor are they permitted to leave children unattended in any area of the Centre at any time. The Centre accepts no responsibility for children either bought into or left in the Centre by a parent or guardian. Customers/members are also not permitted to bring non-members along to the Centre. The members/ customers can visit the Kaizen Café which is open to all during the regular business hours provided the same is not booked for any private function.
The Centre is equipped with video surveillance technology which is constantly recording for the purposes of the security of the Centre and that the video surveillance can be remotely viewed at any time by the Centre operator and/or security provider.
If a customer/member feels dizzy, faint, unwell or feels any unusual pain then they must stop exercising and inform the Center’s staff immediately.
The above terms and conditions are subject to change as per the Management’s decision.
ONLINE BOOKING OFFER
No refunds will be issued for classes booked under the online booking offer. Once the class/classes is/are booked, it is non-transferable and non- refundable. Hence, changing of customer/member names on a confirmed booking will not be allowed. The discount will not be applied if the customer/member chooses to reschedule the class/classes. Any difference in the amount will be payable based on the tariff existing at the time of rescheduling.
ONLINE PAYMENTS
These terms and conditions apply to the customers/members who use the online services provided for any payment made to the Center. Customers/members must read these terms and conditions carefully. By authorizing a payment to the Center through the payment gateway service provider ("the Service"), it would be treated as a deemed acceptance of these terms and conditions. The management reserves all the right to amend these terms and conditions at any time without giving prior notice. It is the responsibility of the customer/member to have read and understood the terms and conditions before using availing the Service.
Payment Terms
Payments using the Service may be made by using card credit, debit cards, net banking, payment wallets and UPI.
The Center is not directly involved in the online payment transactions but through a third-party service provider i.e. payment gateway service provider.
Upon completion of a transaction using the Service, the customer/member will be presented with a confirmation screen verifying the transaction details which the customer/member may wish to process. It is the sole responsibility of the customer/member to verify that all the transaction information and other details are correct.
The Center shall have no liability for transactions which are incorrect as a result of inaccurate data entry in the course of the use of the Service by the customer/member or for loss of data or information caused by factors beyond the control of the Center.
The customer/member will receive a confirmation email/SMS/WhatsApp once the payment has been received by the third-party service provider which will have the ‘Transaction ID’/ ‘Reference No.’, as the case may be.
Every payment made will be verified by Center using the ‘Transaction ID’/ ‘Reference No.’ received by customer/member while executing the payment and a separate transaction receipt will be generated with ‘Transaction ID’/ ‘Reference No.’ as the case may be, confirming the receipt of payment. with QR Code.
The Center shall bear no liability for any decline, refusal, or reversal of payments, as such matters fall solely within the purview of the customer/member and their respective credit card or debit card issuer bank or third-party service provider. In the event that a transaction amount is reflected or credited in the Center's bank account despite a declined transaction, the Center shall undertake the responsibility of initiating a reversal of the said transaction amount within a timeframe of fifteen (15) working days from the date of amount received by the Center or complaint raised by the customer/ member with the Center, whichever is later. However, the Center shall not be held accountable for any delays caused by the card-issuing bank. Further, the Center shall not entertain any request for payment in any other mode except for reversal of the transaction through the same banking channel mode of transfer.
Cancellation or refund will be solely executed as per cancellation and refund terms mentioned below.
TERMS AND CONDITIONS FOR REFUND • All bookings made through the website or physically at the Center are non- refundable.
• No change of booking date is allowed within 24 hours of the scheduled date and class.
• One date change is allowed for a future date with applicable difference amount payable depending on weekday & weekend pricing and can only be done 24 hours prior to the booking date.
• If the booking is done for a weekend, but the rescheduled date is a weekday refund will not be processed for the differential amount.
• No cancellations/refund or transfer of the amount paid towards a class will be processed in case of a no show.
• No refund will be processed if a customer/member utilizes their complimentary/discount coupons offered to them as part of their package/ any promotion offers.
• For every refund executed, the same will have a separate refund receipt generated acknowledging the refund from the Center.
• Once the Center receives the original receipt, the same will be scrutinized and the transaction will be evaluated. Only after approval of the Center, the refund will be initiated through payment gateway service provider. The refund will be processed as per the time frame mentioned below.
• Refunds shall be processed in the same payment form that was used for the bookings. Once an online refund request is generated, the same will be processed as per the time frame mentioned below.

LIABILITY CLAUSE
Set forth below are the terms and conditions of the Center pertaining to the customers/members availing of the programs offered at the Center, and related aspects including but not limited to the customers/members baggage and articles brought into the Center by the customers/members.
The Center shall bear no responsibility in the event of death or physical harm sustained by a customer/member within its premises, including the Kaizen Café. Customers/members who are medically fit are welcome to avail the programs offered by the Center. In case of any concerns regarding the wellness program or food served at Kaizen Café, customers/members are advised to consult their doctor before participating in wellness programs or consuming food items at Kaizen Café, if they wish to do so they do so at their own risk.
No undertaking, guarantee or warranty is given or shall be implied as to fitness, or condition of the equipment and other facilities at the Center, including any food, drink, medicine, or provisions supplied/available at the Center. In no event shall the Center be liable for any incident arising inside or outside the Center.
The customers/members hereby release the Center from any and all liability for any loss of life, injury or damages which is proximately caused by pregnancy, a pre- existing sickness, disease, infirmity disability or illness, whether mental, physical or otherwise of the customer/member.
The Center shall be entitled at any time to cancel or to cease operations by reason of an event of force majeure, which shall include (without limitation) war or threat of war, terrorist activity or the threat of the same, riots, civil commotion, disaster, act of God, natural and nuclear disaster, fire, pandemic, epidemic, strikes, lockdowns declared by the Government (Sate or Central) or other industrial action, and any other event outside its reasonable control and in such situations the Center shall not be liable to the customers/members for failure to perform its obligations mentioned hereinabove.
The Center shall be entitled at any time, without giving any reasons, to refuse entry, passage, to any customer/member, whom the Center considers unfit or a nuisance or likely to cause mischief by reasons of over consumption of alcohol or drugs or likely to inconvenience, endanger or impair the health, safety or reasonable comfort of any person at the Center or likely to endanger or impair safety of the premises of the Center.
If at any stage it is found that any of the classes at the Center is overbooked, the Center reserves the right to decide which customers/members shall be not allowed admission to the class and such decision of the Center shall be binding and final.
The customer/member covenants, represents and warrants that they are fit to proceed, not in any way a nuisance and that their conduct will not in any way cause any mischief or inconvenience, endanger, or impair the health, safety or reasonable comfort of any person or persons at the Center, or endanger or impair the safety of the premises of the Center.
The customer/member shall be liable to and shall reimburse the Center for all damages to the premises of the Center caused directly or indirectly, in whole or in part, by any act or omission of customer/member, whether willful or negligent. The customer/member shall further indemnify the Center against all liability whatsoever arising from any personal injury, death or damage or loss whatsoever caused directly or indirectly, in whole or in part to the Center, by any willful or negligent act or omission on the part of the customer/member.
The customer/member may be subject to security check and agrees and hereby consents to search and security check being made of the customer/member 's person and property whether physically, by way of screening, scanning or otherwise and to the sequestration of any property, which may, in the opinion of the Center and/or any personnel of the Center at the premises, is likely in any way to cause inconvenience, endanger or impair the health, safety or reasonable comfort of any person or persons at the Center, or endanger or impair the safety of the premises of the Center.
The customers/members are always expected to conduct themselves in a proper manner and with due regard to the health, safety, comfort, enjoyment and general well-being of all persons at the Center involved in the provision of any service or facility forming part of the Center.
The customers/members must not carry as baggage or bring to the Center, compressed gases, corrosives, explosives, munitions, fireworks, inflammable article or substance of any kind, weapons, scissors, sharp instruments, radioactive materials, oxidizing materials, poisonous substances, magnetized materials, and any other dangerous articles/ or chattel as may be deemed by the Center ("Prohibited Articles"). The customers/members shall be liable for all penalties imposed by under applicable statutes and for all damages and losses sustained whether by the Center, or any person or property at the Center or otherwise by reason or in consequence of any Prohibited Articles being brought or carried to the Center.
The customers/members are instructed not to accept any packets/packages from unknown persons and are further instructed not to abandon baggage/articles in the premises of the Center. Unattended baggage/articles may be removed by the personnel of the Center as an object of suspicion and shall be confiscated. Any claim for the said baggage/articles will not be entertained.
Any claim for the loss of life or injury or loss of or damage to property of the customers/members shall be notified to the Center in writing ("Notice of Claim") within thirty (30) days from the date when the loss of life or injury occurred or as soon as the loss or damage to the property of the customers/members is discovered. The Notice of Claim shall be served on the Center at its registered office Shop No. G1, Ground Floor, Magsons Towers, Dayanand Bandodkar Marg, Miramar, Panaji, Goa-403001.
Customers/members shall not pay any sums to any agent/person claiming to be the representative of the Center for the purchase of classes, food and beverage or any other services. The Center shall not be responsible for any such payments made by the customers/members on their own volition to any agent/third party, falsely claiming to be the representative of the Center. All payments should be affected only to the official bank accounts of the Center.
Customers/members are hereby informed that the Center does not solicit any investment, partnership, dilution of shares, table sharing/renting or any other kind of investment. Any customers/members dealing with any agent/person claiming to be soliciting investment in the Center shall be doing so at their own risk.
Customers/members are hereby informed that the Center does not operate, associate, collaborate, promote, run any online app. Any customers/members dealing with any such app claiming to be associated with the center shall be doing so at their own risk and shall be solely responsible for the consequences of such dealings.
Any payments made to the Center shall only be against the availment of wellness programs/fitness classes, food and beverages, and other services provided by the Center.
Disputes if any, shall be subject to the jurisdiction of courts in the State of Goa only.
The purchase of food, beverages or services shall be governed by and construed in accordance with the laws of India.
